Privacy Policy
Effective date: October 25, 2026
This Privacy Policy explains how Telogix (“we,” “us,” or “our”) collects, uses, shares, and protects information through the Call Santa website at callsanta.ai and its phone and text-message experience (the “Service”). It also serves as our direct notice to parents about information collected from children. Please read it together with our Terms and Conditions.
1. Children’s privacy and parental consent
The Service lets a child talk with a virtual, AI-powered Santa Claus. Because a child’s voice and statements are personal information, the Service is designed to follow the U.S. Children’s Online Privacy Protection Act (“COPPA”) and the Federal Trade Commission’s COPPA Rule:
- Only a parent or legal guardian aged 18 or older may request a call. Children cannot sign up or request calls.
- Before any call, the parent verifies their mobile number with a one-time code and affirmatively authorizes their child to speak with virtual Santa Claus. No call is placed without this authorization.
- We collect only what is needed for the call and do not ask children for contact or location details.
- We do not sell children’s information, use it for advertising, or build profiles of children.
- Parents may review, request deletion of, or refuse further collection of their child’s information at any time (see Section 7).
2. Information we collect
From the parent (via our website form):
- your mobile phone number;
- your child’s first name and, optionally, age;
- optional notes for Santa (for example, nice-list status or things your child is working on);
- your consent record: date, time, phone number, IP address, and Terms version accepted.
During the call:
- the audio of the call, including your child’s voice, and an automated transcript used to generate Santa’s replies;
- your child’s age, only if you choose to let Santa ask it;
- call metadata such as time, duration, and phone number.
Automatically: basic technical data such as IP address, browser type, and server logs needed to operate and secure the Service. We do not use advertising cookies or third-party ad trackers.
3. How we use information
- to verify your phone number and place the call you requested;
- to let Santa personalize the conversation using the details you provided;
- to record the call and text you a link to the recording;
- to keep the Service safe, prevent abuse, and fix problems;
- to comply with law and keep a record of parental authorization.
4. Service providers
We share information only with service providers that help us run the Service, under contracts or terms that limit their use of it to providing services to us:
- Bandwidth – phone calls, text messages, and call recording;
- Deepgram – real-time speech recognition and voice-agent processing;
- OpenAI – language model that generates Santa’s replies;
- ElevenLabs – Santa’s synthetic voice;
- Cloudflare and our cloud hosting providers – secure hosting and network infrastructure.
We may also disclose information if required by law, to protect the safety of a child or others, or in connection with a merger or sale of our business, subject to this Policy. We do not sell or “share” personal information for cross-context behavioral advertising.
5. Data retention
- Call details you enter on the form (child’s name, age, notes) are deleted from our systems within 24 hours of the call.
- Verification codes expire after 10 minutes.
- The recording link we text you is set to expire after 7 days. Recordings are kept only as long as needed to deliver them to you and are then deleted under our retention schedule, or sooner on request.
- Consent records and limited security logs are kept as long as needed to show compliance and protect the Service.
6. Security
We use reasonable administrative, technical, and physical safeguards, including encrypted connections and restricted access, to protect information. No system is perfectly secure, but we work to protect your family’s information.
7. Your choices and rights
Parents can, at any time, ask to review the personal information we hold about their child, ask us to delete it, or refuse further collection or use. You can also end a call at any time. To make a request, email [email protected] from or with the phone number used for the call so we can verify your identity. Reply STOP to any text to stop receiving messages.
California residents have the right to know what personal information we collect, use, and disclose; to request deletion or correction; to opt out of the sale or sharing of personal information (we do not sell or share it); and to not be discriminated against for exercising these rights. Residents of other states may have similar rights under their state’s laws. Contact us as described above to exercise them.
8. Changes to this Policy
We may update this Policy. If we make material changes to how we collect or use children’s information, we will seek any new parental consent required by law. The effective date above shows the latest version.
